Prosecutor's Office contests Neno Dimov's order for "Kaliakra"

  The Prosecutor's Office seeks the annulment of the order of the Minister of Environment and Water Neno Dimov for the establishment of Kaliakra Protected Area, which defines the protected Ponto-Sarmatian steppes
  
   The Organized Verification by the Supreme Administrative Prosecutor's Office (VAP) of the legality of Order № РД-526 / 21.07.2017 of the Minister of Environment and Water establishes that during the construction of the European ecological network "NATURA 2000" in 2007 was announced The largest area occupied by the Ponto-Sarmatian steppes * 62C0, but in practice it was smaller.
 
   According to the inspection, the order was issued without the Minister of Environment and Waters being explicitly stating that there is a natural habitat in all the locations of the coordinate register, 62C0 * Ponto-Sarmatian steppes.
     
    According to the Verification of the Supreme Administrative Prosecutor's Office, the breach committed is material, as the order was issued for the conservation of this habitat.
 
     In addition, the chosen way of proceeding to the administrative body is also inconsistent with the objectives of ensuring biodiversity and preserving or restoring the favorable conservation status of natural habitats under Articles 2 § 1 and 2 of Directive 92/43 / EEC of 21 May 1992 on the Conservation of Natural Habitats and Wild Flora and Fauna and Article 2, Paragraph 1 of the Biological Diversity Act.
  
    As a result, the VAP disputes item 2 of the Order, which stipulates the prohibition of plowing, afforestation and permanent crops on the territory of Kaliakra Complex with code BG0000573 until its declaration as a protected area but for no more than 2 years Fruit and vegetable crops, grain legumes, leaf-berry crops, root crops, bulb-vegetable crops, oilseeds, fiber crops, essential oil crops, annual or perennial fodder crops application.
 
  
Concerning item 1 of the order prohibiting the issuance of building permits and any construction on the territory designated by the Coordinated Register of the Distribution of Natural Habitats 62C0 * Ponto-Sarmatian steppes, the VAP considered that such actions could harm the protected area At all.
 
In connection with the discovered violations, the documents under Article 8, paragraph 1 of the Biodiversity Act for exploration and creation of map material and a coordinate register at the border of the BG0000573 "Kaliakra Complex" are sent under the jurisdiction of the Supreme Cassation Prosecutor's Office.
 
  
We recall that the Kaliakra case arose after residents of the municipalities of Kavarna, Balchik and Shabla protested in front of the building of the municipality of Kavarna because of the imposed ban on a number of activities in the newly-built Kaliakra Complex. The protests started two weeks ago and an urgent national summit was convened at the Council of Ministers on the issue of Prime Minister Boyko Borisov, Deputy Prime Minister Valeri Simeonov, Minister of Environment and Water Neno Dimov, experts from the Ministry of Environment and Water, representatives of the Bulgarian Academy of Sciences And environmental organizations and associations.
 
 
At the meeting it was decided that the Minister would continue to act until new plans for development were adopted and adopted, the decision for which Minister Dimov personally defended before the European Commission.
On the other hand, environmentalists warned that because of non-compliance with the commitments made by NATURA 2000, our country has been convicted and will be again condemned by the European Commission, as there will be hundreds of cases similar to the Kaliakra case.
